He took "a claim by a summary or four words" in the. Trademarks are not acquired by registration, but use in commerce. Registration in the Trademark Office is not necessarily receive the trademark, but it's for a number of reasons, including increased coverage of your brand advantage.

Another option if you have not used the mark, in commerce, an "intention" before application. However, while this approach significantly increase their costs.

Even if you do not need a trademark lawyer, it seems from your question that you are not yet very familiar with the legal issues. The continuation of the brand in May full of pitfalls - the worst thing that can cause total loss of their trademark rights. I suggest you hire a trademark attorney to assist you.

For more information on trademark law, I suggest you start with the website of the USPTO Trademark FAQ, which is linked below.

And just to clarify, & quot; commercial use is not "necessary to acquire trademark rights. The correct name is actually" use in commerce. "For example, traffic could be a drug for FDA approval as a" commercial use ", but not the" commercial use ".

I should also mention that the title of the individual creative works are usually not registered as trademarks. The main exception to this rule is that if you have a series of works (eg, the Harry Potter series). More information can be found in the test booklet below.

You may not have a domain name as a trademark.

To be registered, must be a brand already in commercial service - you can not be registered "for" its use.

Thus, the sequence of events
To make 1) Start and sell "wazzitcalled" candy.
Wazzitcalled 2) "Registration" as a brand name for its sweets.

You can do the opposite.
